The image was taken at a celebration on a personal yacht. Falwell later explained was a fancy dress party themed after the trailer camp Boys television series. Within the photo, Falwell was holding a glass of dark liquid, and within the caption. He wrote “I promise that’s just black water in my glass. It had been a prop only.” Journalists noted the partial undress and consumption of alcohol were among actions that violate the freedom University code of conduct. A former instructor at the university, Congressman Mark Walker (R–NC), involved Falwell’s resignation. Liberty University announced that Falwell would be taking an “indefinite leave of absence” from his positions On August 7.

On August 23, 2020, Falwell announced during a public statement that his wife, Becki, had had an “improper relationship” several years earlier with a person who later threatened to reveal the affair “unless we agreed to pay him substantial monies”. On August 24, Reuters reported that the person was the pool attendant with whom Falwell had invested within the hostel. The man, now 29 years old, said he began a relationship with the Falwells when he was 20. He claimed that the affair started an equivalent month he met the couple, in March 2012, and continued into 2018. He claimed to possess had “frequent” sexual encounters with Becki Falwell. Husband Jerry Falwell Jr. looked on, sometimes within the same room and sometimes remotely via camera. Liberty University spokesperson had confirmed to a reporter that an announcement of Falwell’s resignation would be “forthcoming”. However, Falwell later denied he had resigned during a call with Politico. When contacted later, the spokesperson declined to comment, saying, “I cannot say anything and that I can only provide a statement from the Board if they provide me a press release .” A university official told The Washington Post anonymously that there had been a delay in negotiations.
